Please read these Terms of Use ("Terms") carefully before using the Sailjourn web app, accessible at www.sailjourn.com (the "Service"), operated by Sailjourn ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Eligibility

   To use the Service, you must be at least 13 years of age. By accessing or using the Service, you represent and warrant that you meet this age requirement.

2. User-Generated Content

   You are solely responsible for any content you upload or post to the Service, including but not limited to GPX files, journey details, descriptions, and photos (collectively, "User Content"). You agree not to submit, upload, or post any User Content that is offensive, inappropriate, or violates any applicable laws or regulations.

3. Disclaimer

   While we strive to provide an accurate and reliable platform, we cannot guarantee the accuracy, completeness, or suitability of the sailing journey information provided by users of the Service. You acknowledge and agree that any reliance on such information is at your own risk.

4. Availability and Liability

   We will make reasonable efforts to maintain the availability of the Service. However, we are not liable for any downtime, unavailability, or interruptions of the Service for any reason, including but not limited to maintenance, technical issues, or updates.

5. Restrictions on Use

   You may not use the Service for commercial purposes, including but not limited to reselling or offering the Service as part of another commercial service. Any unauthorized use of the Service is a violation of these Terms and may result in the immediate termination of your account.

6. Intellectual Property Rights

   You retain all ownership rights to the User Content you submit, upload, or post to the Service. By submitting, uploading, or posting User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content in connection with the Service.

7. Dispute Resolution and Governing Law

   Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in the State of Pennsylvania, in accordance with the rules of the American Arbitration Association. The governing law for these Terms and any disputes shall be the laws of the State of Pennsylvania, without regard to its conflict of law provisions.

8. Changes to Terms

   We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.

   By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

   We reserve the right to terminate or suspend your account and access to the Service, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.
